Summary

You are buying a set of coaching hours, valid for one year after purchase. You can reschedule appointments. If you cancel an appointment within 24 hours, that session will be counted as if it were used. The maximum number of hours per client per week is 3 unless we have made special arrangements. Please treat Shoshana and all other participants with courtesy and consideration.

Shoshana is not a doctor, lawyer, financial advisor, or other specialized professional, though she can help you find and hire such people.

Gourdin Coaching does not store your payment information. Phone numbers, email addresses, and physical addresses are saved so that Shoshana can contact you to provide the coaching you have paid for. Coaching notes are stored in Google documents by default, and you may specify a format that you are more comfortable with if you desire. Gourdin Coaching does not sell customer information. This site is powered by Wix and uses Wix tools.

Terms and Conditions

Welcome to https://www.gourdincoaching.com/. The https://www.gourdincoaching.com/ website (the "Site") is comprised of various web pages operated by Gourdin Coaching. https://www.gourdincoaching.com/ and the coaching you have purchased is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of https://www.gourdincoaching.com/ constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

https://www.gourdincoaching.com/ is an informational and E-Commerce Site.

Gourdin Coaching describes and sells coaching services. Coaching services are sold a set of sessions totaling a number of hours. These hours are valid for 1 year after purchase. After that point, the remaining hours will be treated as paid sponsorship and offered to other participants free of charge. As an alternative, customers may send an email in writing asking for a refund of unused coaching hours; this email must be sent a minimum of 10 days before the hours expire.

There is a maximum of 3 hours of coaching per client per week, with exceptions if agreed upon in writing. Certain dates and times may not be available for coaching services. Cancellations within 24 hours will be counted as hours used and paid for.

Customers may send an email to request a refund of unused hours. Refunds will be made via the same payment method used during purchase.

All participants are expected to display respectful and professional behavior, and at Gourdin Coaching’s discretion, unacceptable or disruptive conduct can lead to termination of coaching services and loss of remaining scheduled hours without reimbursement. Unacceptable conduct includes but is not limited to: insulting or belittling the employees of Gourdin Coaching; insulting or belittling other participants in events; using racial, ethnic, or religious slurs; sexual harassment; discrimination based on protected classes; and threats of any kind.

Privacy
Your use of https://www.gourdincoaching.com/ is subject to Gourdin Coaching's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Electronic Communications
Visiting https://www.gourdincoaching.com/ or sending emails to Gourdin Coaching constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

No Unlawful or Prohibited Use/Intellectual Property
The methods, processes, and techniques provided by Gourdin Coaching via coaching sessions and this website are the intellectual property of Gourdin Coaching and provided to you only as a non-exclusive, non-transferable, revocable license to access and use in accordance with these terms. As a condition of receiving ongoing coaching services, you promise Gourdin Coaching that you will not use its intellectual property for any purpose that is unlawful or prohibited by these Terms. This means you cannot resell, rent, lease, or otherwise offer these services to others as your own. You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the intellectual property, in whole or in part, found on the Site or provided to you as part of the coaching services. We do not grant you any licenses, express or implied, to the intellectual property of Gourdin Coaching or our licensors except as expressly authorized by these Terms.

International Users
The Service is controlled, operated and administered by Gourdin Coaching from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Gourdin Coaching Content accessed through https://www.gourdincoaching.com/ in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification
You agree to indemnify, defend and hold harmless Gourdin Coaching, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or coaching services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Gourdin Coaching reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Gourdin Coaching in asserting any available defenses.

Arbitration
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions. The exclusive venue for arbitration is Massachusetts.

Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Gourdin Coaching agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

Liability Disclaimer
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. GOURDIN COACHING AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Coaching is not a replacement for professional services such as therapy, legal advice, financial planning, or medical care, and that the coach(es) at Gourdin Coaching are not a licensed professional in those fields. Coaching will consist of listening and providing suggestions of techniques that clients can try in their private lives. Clients are not required to use the techniques. Gourdin Coaching is not liable for the outcomes of either using or declining to use them.

Termination/Access Restriction
Gourdin Coaching reserves the right, in its sole discretion, to terminate your access to the Site and the related coaching services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the Commonwealth of Massachusetts and you hereby consent to the exclusive jurisdiction and venue of courts in Massachusetts in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Gourdin Coaching as a result of this agreement or use of the Site. Gourdin Coaching's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Gourdin Coaching's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Gourdin Coaching with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Gourdin Coaching with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Gourdin Coaching with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms
Gourdin Coaching reserves the right, in its sole discretion, to change the Terms under which https://www.gourdincoaching.com/ is offered. The most current version of the Terms will supersede all previous versions. Gourdin Coaching encourages you to periodically review the Terms to stay informed of our updates.

To wit, we will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.

We do not store or handle credit card information. Payments are handled by Wix, a third party tool.
